Services - Stratum Subdivision Quick Links

A stratum subdivision is a Torrens subdivision with one or more lots limited in height depth or both. As the name implies, the lots are limited to a particular stratum. This stratum may be horizontal planes or inclined planes or a combination of the two.

These types of subdivision are particularly where you may wish to set up 2 or more strata schemes in a single building, or for the absolute protection of views.

A stratum plan is generally quite complex; hence these cost more than a simple subdivision plan.

There is no such concept as common areas as all parts of a building or parcel must be owned. Generally the use of “common” areas requires the creation of a series of easements designed to ensure reasonable usage of all parts of the building. These easements will typically include;

  • Access for vehicles and pedestrians
  • Support and Shelter
  • Services
  • Light and Air
  • Fire Egress
  • Right to use lifts, stairs, loading docks etc
  • Anything else required for any individual case

Put simply, this type of subdivision allows someone to own stuff over (or under) someone else.
