Torrens subdivisions are so named because of their title system. These are really subdivisions of land held under the Real Property Act.
Torrens subdivision creates a series of lots to be held in fee simple and the plans will commonly also create easements for such things as support, drainage, services and rights of access. It is also common to create Positive Covenants and Restrictions on use of land with these plans.
In the majority of cases, council consent to the subdivision will be required as subdivision is included in the definition of development under the Environmental Planning and Assessment Act. In an increasing number of cases, the subdivision development is also Integrated development under the Environmental Planning and Assessment Act, meaning consent of additional authorities such as the Rural Fire Services or DIPNR will also be required.
Service authorities must be consulted in the subdivision process. For example a section 73 certificate is required from Sydney Water before any subdivision can be signed off by council. Telstra and the electricity supply company are also involved in the process.
