The issue of overshadowing is very real to a vast number of people, whether they be the applicants in a particular matter, or a neighbour who needs to ensure that adequate sunlight will be available to them post development. Councils increasingly need to know the impact of a proposed development on the neighbours in terms of available sunlight, and if it becomes a large issue, the Land and Environment Court will need the same questions answered.

When preparing these we can use a first principles drafting approach, or we can use a software driven approach to an answer, either way, the set up data must be accurate, and north must relate to true north, not magnetic, and care needs to be taken in determination of the difference between the 2 norths.
